Article 1 \u2013 Definitions<\/strong><\/p>

In these terms and conditions, the following terms are understood:<\/p>

  1. Consideration period<\/strong>the period within which the consumer can exercise their right of withdrawal;<\/li>
  2. Consumer<\/strong>: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur;<\/li>
  3. Good day<\/strong>: calendar day;<\/li>
  4. Long-term transaction<\/strong>: a distance agreement regarding a series of products and\/or services, the delivery and\/or purchase obligations of which are spread over time;<\/li>
  5. Sustainable data carrier<\/strong>Any means that enables the consumer or entrepreneur to store information that is directed at them personally in a way that allows for future consultation and unchanged reproduction of the stored information.<\/li>
  6. Right of withdrawal<\/strong>the possibility for the consumer to withdraw from the distance contract within the cooling-off period;<\/li>
  7. Model form<\/strong>the model form for withdrawal that the entrepreneur makes available which a consumer can fill in when they wish to exercise their right of withdrawal.<\/li>
  8. Entrepreneur<\/strong>: the natural or legal person that offers products and\/or services remotely to consumers;<\/li>
  9. Distance contract<\/strong>: an agreement whereby, within the framework of a system for the distance sale of products and\/or services organized by the entrepreneur, use is made exclusively of one or more techniques for remote communication until the conclusion of the agreement;<\/li>
  10. Technology for remote communication<\/strong>: means that can be used to conclude an agreement, without the consumer and the entrepreneur having gathered in the same space at the same time.<\/li>
  11. Terms and Conditions<\/strong>: the present General Terms and Conditions of the entrepreneur.<\/li><\/ol>

    Article 3 \u2013 Applicability <\/strong><\/p>

    1. These general terms and conditions apply to all offers from the entrepreneur and to any distance agreements and orders concluded between the entrepreneur and the consumer.<\/li>
    2. Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance agreement is concluded that the general terms and conditions are available to the entrepreneur and that they will be sent to the consumer free of charge as soon as possible upon request.<\/li>
    3. If the agreement is concluded electronically, by way of derogation from the previous paragraph, and before the agreement is concluded electronically, the text of these general terms and conditions may be made available to the consumer by electronic means in such a way that it can be easily stored by the consumer on a durable data medium. If this is not reasonably possible, before the agreement is concluded electronically, it will be indicated where the general terms and conditions can be accessed electronically and that they will be sent free of charge by electronic means or by other means at the request of the consumer.<\/li>
    4. In case specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs shall apply accordingly and the consumer may, in the event of conflicting general conditions, always rely on the applicable provision that is most favorable to him.<\/li>
    5. If one or more provisions in these general terms and conditions are at any time wholly or partially invalid or nullified, the agreement and these terms and conditions shall otherwise remain in effect and the relevant provision shall be promptly replaced, by mutual agreement, with a provision that approaches as closely as possible the original intent.<\/li>
    6. Situations that are not regulated in these general terms and conditions must be assessed \u2018in the spirit\u2019 of these general terms and conditions.<\/li>
    7. Any ambiguities regarding the interpretation or content of one or more provisions of our terms and conditions should be interpreted \u2018in the spirit\u2019 of these general terms and conditions.<\/li><\/ol>

      Article 4 \u2013 The offer<\/strong><\/p>

      1. If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer.<\/li>
      2. The offer is non-binding. The entrepreneur is entitled to change and adapt the offer.<\/li>
      3. The offer includes a complete and accurate description of the products and\/or services offered. The description is sufficiently detailed to enable a good assessment of the offer by the consumer. If the entrepreneur uses images, these are a true representation of the products and\/or services offered. Obvious errors or obvious errors in the offer do not bind the entrepreneur.<\/li>
      4. All images, specifications and data in the offer are indicative and cannot constitute grounds for compensation or termination of the agreement.<\/li>
      5. Images of products are a faithful representation of the products offered. The entrepreneur cannot guarantee that the colors displayed exactly match the actual colors of the products.<\/li>
      6. Each offer contains information that is clear to the consumer about the rights and obligations that are associated with the acceptance of the offer. This includes in particular:
